tamos AI is a brand product of Brandmerce, LLC, a Florida limited liability company ("Brandmerce," "tamos AI," "tamos," "we," "us," or "our"). tamos provides software tools that help parents and legal guardians plan, organize, document, and preserve a homeschool student's learning record and build evidence of the student's work through profiles, portfolios, projects, records, transcripts, reports, and other proof-building tools.


We are not a school, school district, evaluator, counselor, attorney, admissions office, employer, credentialing body, or government agency. We provide software and organizational tools. Parents and legal guardians remain responsible for homeschool decisions, the accuracy of records, legal compliance, and decisions about access, export, publication, and sharing.


These Terms of Service (the "Terms") govern access to and use of the tamos websites, applications, software, AI features, Portfolio Builder, Student Profiles, Project Cards, recordkeeping tools, exports, sharing features, and related services (collectively, the "Services").


1. Acceptance of These Terms

By creating an account, purchasing a subscription, authorizing Student Access, accepting an invitation, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.


2. Definitions

For these Terms:

**"Parent Administrator"** means the parent, legal guardian, or other adult account holder who has lawful authority to establish and administer a student's tamos workspace and provide instructions regarding the processing of student information.


**"Student Access"** means optional, permission-based access granted by the Parent Administrator to a student so the student may access authorized portions of the student's own tamos profile, Portfolio, projects, records, or other approved features.

**"Authorized User"** means a Student Access user or another person intentionally invited by the Parent Administrator, such as a co-parent, legal guardian, evaluator, tutor, mentor, consultant, or other recipient.

**"Family Content"** means records, information, text, images, video, audio, files, grades, course information, project materials, portfolio artifacts, transcripts, certificates, links, notes, prompts, outputs, and other content submitted to or created within a tamos workspace by or at the direction of the Parent Administrator or an Authorized User.

***Portfolio Content*** means student work, project evidence, artifacts, photos, videos, writing samples, research, designs, code, links, certificates, venture records, trade work, demonstrations, presentations, reflections, skill tags, descriptions, or similar proof-building materials stored or organized through the Services.


3. Eligibility and Parent-Directed Use

The primary tamos family account must be created and administered by an adult who is at least 18 years old and who represents that they are a parent, legal guardian, or otherwise have lawful authority to manage the applicable student's records and provide processing instructions to tamos.


A student may not independently establish a parent-controlled family workspace or override the Parent Administrator's permissions.


The Parent Administrator is responsible for:

- providing accurate account and student information;

- determining whether the Parent Administrator has legal authority to create and manage records for each student added to the account;

- deciding whether and when to enable Student Access;

- deciding who may view, edit, export, or receive student information;

- reviewing student-created or AI-assisted content before it is relied upon or shared; and

- complying with homeschool, scholarship, school, program, employment, apprenticeship, credentialing, and other requirements that apply to the family.


4. Parent Administrator Control and Student Access

tamos is designed as a **parent-controlled homeschool record and proof-building platform.

The Parent Administrator is the primary administrator of the family workspace and controls account permissions. The Parent Administrator may choose to grant a student access to authorized portions of that student's own profile and Portfolio so the student can help build, document, and organize evidence of learning and experience.


Depending on the features enabled by the Parent Administrator, a student may be permitted to:

- view the student's own profile, milestones, or progress;

- add or draft Portfolio Content;

- upload project evidence or artifacts;

- create or edit project descriptions or reflections;

- add links, files, images, video, or other proof of work;

- identify skills or experiences associated with a project;

- respond to prompts or use approved AI features; and

- perform other actions expressly permitted by the Parent Administrator.


Student Access is permission-based, limited, and revocable. The Parent Administrator may change permissions, suspend Student Access, remove Student Access, edit records, remove content, approve or decline sharing, revoke share links, export records, or delete student data, subject to applicable law and technical retention requirements described in the Privacy Policy.


A student does not receive authority to independently publish or disclose the student's complete academic record, transcript, private Portfolio, or other protected Family Content unless the Parent Administrator has expressly enabled the applicable sharing feature.


Where applicable law requires verifiable parental consent before tamos collects personal information directly from a child under 13, tamos may require a parental notice and consent process before direct Student Access is enabled.


5. Parent-Controlled Sharing and Authorized Recipients

The Parent Administrator may choose to share selected records or outputs with people or organizations selected by the Parent Administrator, including, for example:

- the student;

- a co-parent or legal guardian;

- homeschool evaluators;

- tutors, mentors, or consultants;

- co-ops or microschools;

- schools or school districts;

- scholarship programs;

- colleges, universities, or admissions offices;

- trade schools or apprenticeship programs;

- employers or internship providers;

- credentialing or certification organizations;

- family members; or

- other recipients selected by the Parent Administrator.


The Parent Administrator controls **whether to share, what to share, with whom to share, and when to revoke access** where the applicable feature allows revocation.


No school, scholarship organization, college, evaluator, employer, co-op, government agency, or other institution receives automatic or default access to a family's private tamos workspace solely because the family uses tamos.


The Parent Administrator is responsible for choosing recipients and confirming that any recipient information is correct before sending an invitation, export, or share link.


Revoking a live tamos share link may stop future access through that link. Revocation cannot retrieve, erase, or control copies that a recipient previously downloaded, printed, photographed, forwarded, stored, or otherwise retained outside the Services.


6. Portfolio Builder, Proof-Building Records, and Student Profiles

The Services may allow a family to create a living Student Profile and Portfolio designed to document work and experiences over time.


Portfolio Content may include academic work and nontraditional evidence of learning, such as projects, research, ventures, trade work, service, certifications, employment, internships, presentations, creative work, technical builds, AI-assisted work, and other real-world outcomes.


The Parent Administrator is responsible for determining what content is appropriate to store, publish, export, or share.


Unless the Parent Administrator intentionally activates a public or externally shareable feature, Portfolio Content and Student Profiles are intended to remain within the parent-controlled workspace or within the permissions selected by the Parent Administrator.


When a public or shareable Portfolio or Student Profile feature is enabled:

- the Parent Administrator is responsible for selecting the information made available;

- the Parent Administrator should avoid publishing unnecessary personal or sensitive information;

- the Parent Administrator may revoke or unpublish the tamos-hosted share where supported;

- public information may be viewed, copied, saved, indexed, or redistributed by third parties outside tamos's control; and

- tamos cannot guarantee removal of copies retained by third parties after publication or sharing.


7. Ownership of Family Content and Student Work

As between tamos AI and the account holder, tamos does not claim ownership of Family Content merely because it is uploaded, stored, organized, or processed through the Services.

The Parent Administrator controls the family workspace and the permissions associated with student records stored in that workspace.


Ownership of the underlying intellectual property in a student's original work remains with the applicable creator or rights holder under applicable law. These Terms do not transfer a student's copyright or other intellectual property rights to tamos.


By submitting Family Content to the Services, the Parent Administrator grants Brandmerce, LLC a limited, non-exclusive license to host, store, reproduce, process, analyze, format, transmit, and display the content only as reasonably necessary to operate, secure, maintain, and provide the Services and fulfill authorized requests.


The Parent Administrator represents that the Parent Administrator has the rights, permissions, or lawful authority needed to upload, process, and direct tamos to use Family Content.


8. Accuracy and Authenticity of Proof

tamos provides tools to organize evidence. tamos does not independently certify that a project was completed by the student, that uploaded evidence is original, that a stated number of hours is correct, that a credential is valid, or that a skill has been mastered unless a specific verification feature expressly states otherwise.


Parents and students are responsible for the truthfulness, accuracy, legality, originality, and appropriate attribution of content they submit.


You may not knowingly use tamos to fabricate academic records, falsify transcripts, misrepresent credentials, impersonate another person, submit another person's work as the student's own, or create fraudulent proof.


9. What tamos Provides — Software Only

tamos provides organizational, documentation, Portfolio, proof-building, planning, sharing, and output-generation tools.


We do not:

- operate as a school or issue a diploma merely because you use the Services;

- serve as a homeschool evaluator unless separately and expressly contracted through a qualified person;

- certify compliance with state homeschool law;

- guarantee acceptance of a transcript, Portfolio, credit, course, project, credential, or record;

- make admissions, employment, apprenticeship, scholarship, or credentialing decisions;

- guarantee that a Portfolio or other proof will produce any particular outcome; or

- provide legal, tax, medical, financial, or other regulated professional advice.


10. No Submission on Your Behalf

Unless a specific feature and separate written terms expressly state otherwise, tamos does not file, transmit, or submit documents to third parties on your behalf.


The Parent Administrator is responsible for final review and submission to schools, districts, scholarship programs, colleges, employers, apprenticeship programs, credentialing organizations, or government agencies.


11. Scholarship Programs and Step Up For Students

If you use the Services in connection with a scholarship program, including Step Up For Students or an Education Market Assistant ("EMA") portal, you remain responsible for meeting program requirements, completing required entries, verifying deadlines, and making required submissions.


tamos is an independent software product and is not affiliated with, endorsed by, or acting on behalf of Step Up For Students or a government agency unless an express written agreement states otherwise.


12. AI Features and Automated Drafts

AI features are optional unless a specific workflow states otherwise. AI may help organize, summarize, classify, draft, tag, or suggest information based on records or Portfolio Content authorized for processing.


AI may, for example:

- draft project or Portfolio descriptions;

- suggest tags, skills, or categories;

- summarize work or activity records;

- draft transcript-related or recordkeeping text;

- organize selected projects or evidence;

- suggest next steps or informational resources; or

- create other draft outputs.


AI outputs are automated drafts. AI may be inaccurate, incomplete, biased, outdated, or may misinterpret Portfolio Content.


AI does not independently verify authorship, originality, plagiarism, skill mastery, credential validity, project completion, legal compliance, admissions eligibility, or employment readiness.


The Parent Administrator and, where permitted, the student must review and correct AI outputs before relying on or sharing them.

13. AI Providers and Private Workspace Data

We may use third-party AI service providers as subprocessors to generate AI-assisted features. We take steps to contractually restrict providers from using private tamos workspace content to train public foundation models, subject to the provider arrangements and disclosures described in our Privacy Policy and AI Disclosures.


tamos does not use private Family Content to train public AI models for unrelated users.

We may use aggregated or de-identified technical information to improve reliability, safety, and product performance where permitted by law.


14. User Content and Sharing Responsibility

You are responsible for content you upload, publish, export, or share.

Before sharing student information, consider whether the recipient needs the student's full name, birth date, address, contact information, grades, test scores, disability information, health information, financial information, photographs, or other sensitive information.


Where available, use field-selection, redaction, expiration, access-control, or privacy tools before sharing.

We are not responsible for a recipient's use, retention, publication, or redistribution of content after you direct tamos to share it or after you independently provide it to the recipient.


15. Account Security

You must keep account credentials confidential and use reasonable security measures.

The Parent Administrator is responsible for reviewing Authorized Users and removing access that is no longer appropriate.


You must promptly notify us at **info@tamos.ai** if you suspect unauthorized access, credential compromise, or misuse of a student workspace.


16. Acceptable Use

You may not:

- access or attempt to access another family's data without authorization;

- upload unlawful, harmful, abusive, exploitative, or infringing content;

- use the Services to exploit, groom, harass, threaten, or endanger a child;

- falsify academic, employment, trade, scholarship, or credential records;

- knowingly misrepresent another person's work as a student's work;

- scrape or harvest student information;

- use student data for targeted advertising or behavioral profiling;

- bypass permissions, rate limits, security, or privacy controls;

- reverse engineer the Services except where applicable law expressly permits it; or

- use AI features for unlawful or prohibited high-risk purposes.


We may suspend or terminate access when reasonably necessary to protect students, families, other users, Brandmerce, or the Services.


17. Intellectual Property in the Services

The Services, software, interfaces, branding, product designs, templates, platform content, and related intellectual property are owned by Brandmerce, LLC or its licensors and are protected by applicable law.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for authorized personal, family, homeschool, or other purchased use.


18. Third-Party Services

The Services may rely on or link to third-party services, including payment processors, cloud providers, analytics providers, communication providers, AI providers, or external websites.


Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party services or content except to the extent required by applicable law.


19. Plans, Billing, Taxes, and AI Usage Limits

Fees, billing periods, plan limits, storage limits, AI usage limits, credits, and included features are described at checkout, on the applicable pricing page, or in the Services.

Charges are due in advance of the applicable subscription term unless stated otherwise.

We may apply reasonable quotas, rate limits, storage limits, or usage controls to maintain system stability, safety, and plan limits.


Renewal, cancellation, and refund rules are governed by the Cancellation & Renewal Policy and any plan-specific terms displayed at purchase.


20. Cancellation, Data Export, and Account Deletion

Canceling a paid subscription stops future renewal according to the Cancellation & Renewal Policy. Cancellation does not automatically delete the family's records.


The Parent Administrator should export records the family wishes to retain before requesting account deletion.


Account and data deletion are handled under the Privacy Policy and applicable law.


21. Students Who Reach the Age of Majority

A Parent Administrator may continue to manage a family workspace containing records that the Parent Administrator created and maintained for a student. However, when a student reaches the age of majority or otherwise obtains privacy rights under applicable law, tamos may require updated permissions, additional consent, identity verification, or an account transition process where legally required.

Nothing in these Terms is intended to waive rights that an adult student may have under applicable law.


22. FERPA and Institutional Use

The Family Educational Rights and Privacy Act ("FERPA") generally applies to educational agencies and institutions that receive funding under programs administered by the U.S. Department of Education.

Parent-directed use of tamos does not, by itself, make tamos a school or make every family workspace subject to FERPA.


If a FERPA-covered institution engages Brandmerce, LLC to provide tamos services, the applicable institutional relationship may be governed by a separate written agreement, data protection terms, or other terms required for that relationship.


23. Suspension and Termination

We may suspend or terminate access for material breach of these Terms, unlawful activity, fraud, non-payment, abuse, security risk, child-safety risk, or conduct that threatens the Services or another user.

You may stop using the Services and cancel your subscription as described in the Cancellation & Renewal Policy.


24. Disclaimers

THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY LAW, BRANDMERCE, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY RECORD, TRANSCRIPT, PORTFOLIO, AI OUTPUT, PROJECT, SKILL TAG, REPORT, OR OTHER OUTPUT WILL BE ACCEPTED BY A SCHOOL, COLLEGE, SCHOLARSHIP PROGRAM, EMPLOYER, APPRENTICESHIP PROGRAM, CREDENTIALING BODY, EVALUATOR, OR OTHER THIRD PARTY.


25. Limitation of Liability

To the fullest extent permitted by law, Brandmerce, LLC's total liability for claims arising out of or related to the Services will not exceed the amount paid by you to Brandmerce, LLC for the Services during the twelve months immediately preceding the event giving rise to the claim.

To the fullest extent permitted by law, Brandmerce, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, admission, scholarship, employment, business, revenue, or reputation.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.


26. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Brandmerce, LLC and its officers, members, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from or related to:

- Family Content you submit or direct us to process;

- your violation of these Terms or applicable law;

- your invitations, permissions, publication, export, or sharing decisions;

- your misrepresentation of student work, credentials, hours, grades, or other records; or

- your infringement of another person's rights.


27. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in Florida.


28. Changes to These Terms

We may update these Terms from time to time.

We will provide notice of material changes as required by law, which may include email or in-app notice. The "Last Updated" date will identify the current version.

Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.


29. Entire Agreement; Severability; Survival

These Terms, together with the Privacy Policy, Cookie Policy, AI Disclosures, Cancellation & Renewal Policy, and any plan-specific written terms, form the agreement governing the Services.

If a provision is held unenforceable, the remaining provisions remain in effect.

Provisions that by their nature should survive termination will survive, including provisions concerning ownership, licenses, disclaimers, limitation of liability, indemnification, and dispute terms.
